Terms of Service

These Terms of Service govern your use of the SS Deckly platform, operated by SS Deckly LLC, a company registered in the Sharjah Media City Free Zone, United Arab Emirates (Licence No. 2647895.01, Formation No. 2647895). References to "SS Deckly," "we," "us," or "our" refer to SS Deckly LLC.

By creating an account or using the platform you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the platform.

These Terms apply to all users including hospitality operators, hotels, resorts and marinas, customers and visitors.

SS Deckly provides a cloud-based Software as a Service platform enabling hospitality and marina operators to manage bookings, team, experiences, customer relationships, payments and communications.

The platform facilitates booking transactions between operators and their customers. SS Deckly acts as a technology intermediary only and is not a party to any booking agreement between operators and their customers.

SS Deckly reserves the right to modify, suspend or discontinue any part of the service at any time with reasonable notice to registered users.

You must be at least 18 years of age and have legal authority to enter into binding agreements to create an account.

You agree to provide accurate, current and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at hello@ss-deckly.com of any unauthorised access to your account.

You are fully responsible for all activities that occur under your account.

SS Deckly offers paid subscription plans as published on our pricing page. All prices are in UAE Dirham (AED) unless otherwise stated.

Subscriptions are billed monthly or annually in advance. By subscribing you authorise SS Deckly to charge your payment method on a recurring basis.

SS Deckly does not process, store, or have access to payment details exchanged directly between guests and operators/partners. The only payments processed by SS Deckly are subscription fees charged to operators.

Subscription fees are non-refundable except where required by applicable UAE consumer protection law. If you believe a refund is warranted, contact hello@ss-deckly.com and we will review on a case-by-case basis.

We reserve the right to modify pricing with 30 days written notice. Continued use after the notice period constitutes acceptance of new pricing.

Failure to maintain valid payment details may result in suspension of your account.

You agree to use SS Deckly only for lawful purposes and in accordance with these Terms.

You must not: use the platform to facilitate any illegal activity; upload false, misleading or fraudulent content; attempt to gain unauthorised access to any part of the platform; interfere with the platform's operation or other users' use; reverse engineer, copy or create derivative works from the platform; use automated tools to scrape or extract data without written consent.

Operators are solely responsible for ensuring their business operations comply with all applicable UAE regulations, including maritime and hospitality licensing requirements where relevant.

Operators using SS Deckly to manage their hospitality and marina business are solely responsible for: the accuracy of experience information, pricing and availability; compliance with all safety, insurance and licensing requirements; the quality and delivery of services to customers; resolving any disputes with their customers; complying with UAE consumer protection laws.

SS Deckly is a technology platform and bears no liability for the quality, safety or legality of services provided by operators.

All content, software, design, trademarks and intellectual property on the SS Deckly platform are owned by SS Deckly or its licensors.

You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for its intended purpose during your subscription.

You retain ownership of all content you upload to the platform including experience photos, descriptions and company materials.

By uploading content you grant SS Deckly a licence to use, display and reproduce it for the purpose of operating and improving the platform.

Our collection and use of personal data is governed by our Privacy Policy at ssdeckly.com/privacy-policy, which forms part of these Terms.

By using the platform you consent to the collection and processing of data as described in the Privacy Policy.

To the maximum extent permitted by UAE law, SS Deckly shall not be liable for any indirect, incidental, special, consequential or punitive damages including loss of profits, data or business arising from your use of the platform.

Our total liability to you for any claim arising from these Terms shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.

SS Deckly does not warrant that the platform will be uninterrupted, error-free or secure at all times.

You agree to indemnify and hold harmless SS Deckly, its officers, directors, employees and agents from any claims, damages, losses or expenses including legal fees arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or third party rights.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

SS Deckly reserves the right to suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or fail to pay applicable fees.

Upon termination you may export your data for 30 days. Following that export window, your data is retained for a minimum of 5 years to comply with UAE commercial and financial record-keeping requirements (consistent with our Privacy Policy Section 7). Deletion requests are subject to these legal retention obligations — to submit one, email hello@ss-deckly.com.

These Terms are governed by the laws of the United Arab Emirates and the regulations of the Sharjah Media City Free Zone.

Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good faith negotiation.

Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Sharjah Courts.

These Terms constitute the entire agreement between you and SS Deckly regarding the platform.

If any provision is found unenforceable, the remaining provisions remain in full force.

Our failure to enforce any right does not constitute a waiver of that right.

We may update these Terms from time to time with notice to registered users.
